The Supreme Court is likely to rule that the 20th amendment to the constitution needs a two-third parliamentary majority and a public mandate at a referendum, legal sources say. The SC on September 06 began taking up 13 petitions that challenge the amendment and will make its ruling on September 19.
The amendment proposes to hold elections to all PCs on a single day and to transfer election commission’s power to decide dates for PC polls to parliament and for parliament to take over a PC in the event it is dissolved before completing its five year term.
If the SC says a referendum is needed, a constitutional amendment will be a failure, political sources say. Since the government does not want to go for elections right now, it will withdraw the amendment, they say.
