Telshan Network (Pvt) Limited says that they were not informed of removing transmission equipment of their Polgahawela transmission station in advance and TRC has performed improperly during the process of shutting down the transmission station.
They said that they will present their facts to Polgahawela Magistrate Court on coming 8th.
Shan Wickramasinghe mentions that neither he nor any other responsible person of TNL has been informed of this issue by the TRC before taking legal actions. He further said that the company is facing a large financial loss due to hastily removing equipment without any warning and legal actions will be taken against them. He emphasized that his company has made all relevant payments to the TRC.
However, Director General of TRC P.R.S.P. Jayathilaka says that although licenses have been obtained for TNL transmission stations in Colombo, Nuwaraeliya, Karagahathanna, Piliyandala, Awissawella, Badulla, Hantana and Rathnapura, no license has been obtained to use VHF 11 and VHF 03 in Polgahawela. He further said that TNL has violated section 22 of the Telecommunications Act.
He said that a letter dated 27.4.2016 has been sent requesting TNL to stop this illegal transmission operation but TNL has continued to do so.
The Director General of TRC further said that they had to take above legal actions because TNL has violated Telecommunications Act no 27 of 1996 and Act no 25 of 1991 and there is no other reason behind it.
