Barely one hour after publishing our story titled "Cabinet Ministers a 'Pack of Jokers' Thanks To President Counsel Minister Faizer Mustapha" Secretary to the Ministry of Local Government, Provincial Councils and Sports Dulara Gunatilleke accepting this blunder issued a press release to all Media Institutions stating that the submitted and approved cabinet paper had in fact had a typing error.
However in his attempt to justify the error the Secretary further goes on to mislead all Media Institution Heads stating “Due to a typing error although the heading clearly stated Gazette Extraordinary notice was under the section 41 (1) of Act 25 of 1973 the final portion of the note had been typed as 44 (1).”
The letter further states “The Hon Minister had at the meeting of the 24th of July 2018 brought this error to the attention to the Cabinet Ministers and had obtained their concurrence.”
Secretary Dulara Gunatilleke’s press release further misleads all Media Heads, as the error is not made only on the final portion of the note but is found on page 1 of 2 under the sub headings 2. Justification and on page 2 of 2 under the sub headings 3. Legal Compliance & 4. Recommendations.
Like the Minister Faizer Mustapha’s submitted error filled cabinet paper, even this press release to the Media Heads is also riddled with misleading facts.
However the mockery of this submitted cabinet paper by Minister Faizer Mustapha further states under 3. Legal Compliance - “Section 41 (2) requires the Minister to publish every Regulation made under section 44 (1) in the Government Gazette and then, Section 44 (4) requires him to table it in Parliament for approval as soon as convenient after its publication in the Gazette.
According to the above mentioned paragraph even if the number 44 is replaced by 41, there is no such section in the Sports Law as 41 (4), as Section 41 ends with 41 (3).
The press release also goes on to state that Minister Faizer Mustapha when submitting the error filled cabinet paper had informed Cabinet Ministers present about the error.
However a Cabinet Minister close to Prime Minister Ranil Wickremesinghe who was present at the Cabinet Meeting speaking on condition of anonymity said “That is a blatant lie. Minister Faizer Mustapha never pointed out any error in his submitted cabinet paper at the said Cabinet Meeting. He would have been instructed to have it rectified before the Cabinet of Ministers approved it.”
Despite making the Cabinet of Ministers a ‘Pack of Jokers’, President Counsel and Minister Faizer Mustapha is now attempting to mislead the general public through the media, by also releasing misleading press releases through his Secretary Dulara Gunatilleke.
