New BIA building construction tender taints with irregularities

July 15, Colombo (LNW): An alleged fraud involving a tender award by Airport and Aviation Services (Sri Lanka) Ltd. (AASL) for constructing a new building at Bandaranaike International Airport (BIA) has been exposed, informed sources said.

The Technical Evaluation Committee (TEC) had rejected a particular bidder due to non-compliance with the tender specifications, yet this bidder was later awarded the contract by the Procurement Appeal Board (PAB), raising concerns of potential corruption.

The Ministry of Ports, Shipping and Aviation, with a history of bribery allegations, called for international competitive bids in December 2023. Five bidders submitted quotes: Sanken Construction, a JV of Tudawe Brothers and China Harbour Engineering Company (TB-CHEC), Maga Engineering, China Civil Engineering Construction Corporation, and a JV of Consulting Engineers and Contractors and China Nautical Aero Technology International Engineering Corporation (CEC-CAIEC).

TEC evaluated these bids, recommending Sanken Construction as the lowest responsive bidder. However, the PAB, led by G.S. Withanage, awarded the contract to the technically non-compliant CEC-CAIEC JV. Despite TEC and the Standing Cabinet Appointed Procurement Committee (SCAPC) approving Sanken, the PAB favored CEC-CAIEC, citing domestic preference regulations inaccurately.

Sanken Construction’s Managing Director, Eng. Ranjith Gunatilleke, and Executive Director, Eng. Susil Rodrigo, expressed concerns over procedural irregularities.

They highlighted the Ministry Secretary’s failure to notify them of their bid’s success and the PAB’s decision, which violated natural justice principles by excluding them from the appeal process. They argued that the PAB’s decision undermined the integrity and transparency of the procurement process, posing risks to the project’s successful completion.

Gunatilleke requested transparency from the Ministry Secretary and appealed to the Cabinet of Ministers to halt the award to CEC-CAIEC. He filed an RTI application, revealing TEC’s report confirming Sanken’s compliance and CEC-CAIEC’s non-compliance.

The case exposed significant flaws and potential biases in the procurement appeal process, leading to concerns about the Ministry’s operational integrity and the overall attractiveness of Sri Lanka as a business destination.

Executive Director Sanken Construction (Pvt) Ltd, Eng. Susil Rodrigo said that they were kept in the dark by the Ministry Secretary from the initial stage by not notifying that they were the successful bidder as per the TEC recommendation.

The TEC report stands as a clear testimony to the fact that no other bidder other than Sanken, is lawfully entitled to be recommended to offer the tender which was agreed to by SCAPC. 

By excluding Sanken Construction from the appeal procedure adopted by the PAB, we were made unaware of the conclusions/ recommendations of the PAB. 

The procurement appeal process followed by the PAB is completely flawed and tainted by substantive errors as well as procedural errors,” said Rodrigo.

July 15, Colombo (LNW): The Sri Lankan Rupee (LKR) indicates appreciation further against the US Dollar today (15) in comparison to last week, as per the official exchange rates released by the Central Bank of Sri Lanka (CBSL).

Accordingly, the buying price of the US Dollar has dropped to Rs. 297.19 from Rs. 298.27, and the selling price to Rs. 306.40 from Rs. 307.46.

The LKR also indicates appreciation against several other foreign currencies as well, including Gulf currencies.

July 15, Colombo (LNW): The Human Capital Summit was an idea of President Ranil Wickramasinghe when he was Prime Minister. He wanted to create a platform to bring all the key actors together to final solutions to our skills challenges.

A well-educated and skilled workforce is essential for driving economic growth through productivity gains and innovation.

Therefore, Sri Lanka needs to make significant strides in improving its education system, an educated populace will provide a strong foundation for economic development.

Unfortunately Sri Lanka has lost millions of trained talent to developed countries.

Sri Lanka experienced a significant loss of young talent in 2022. This loss of young talent poses significant long-term challenges for Sri Lanka, including a potential slowdown in innovation, reduced economic growth, and a weakened talent pool for future development of the country.

To address these challenges Sri Lanka needs to stabilise its economy, improve governance, and create conditions that make staying and contributing to the local economy attractive for its young professionals.

Retaining young educated workers is a critical challenge for Sri Lanka, requiring a multifaceted approach. The Human Capital Summit 2024 on the 18 th will focus on strategies that have worked to reverse the brain drain and also on key short term strategies that can can help build a strong talent pool in the shortest possible time for selected key sectors in the Sri Lankan Economy.

SL’s Apex Court orders ex-President Sirisena to settle compensation for Easter Carnage victims by end of August

July 15, Colombo (LNW): The Supreme Court has mandated that former President Maithripala Sirisena settle the outstanding compensation of Rs. 100 million owed to victims of the 2019 Easter Sunday carnage by August 30, 2024.

Ex-President Sirisena had previously paid Rs. 58 million towards the compensation but requested an additional six years to pay the remaining amount, which was disclosed during proceedings before the Supreme Court.

In January 2023, the Supreme Court ruled on a case involving Sirisena and other former officials implicated in the failure to prevent the Easter attacks despite prior intelligence.

Alongside Sirisena, former Defence Secretary Hemasiri Fernando was ordered to pay Rs. 50 million, former State Intelligence Service Director Nilantha Jayawardena and former Inspector General of Police Pujith Jayasundara were each directed to pay Rs. 75 million, and National Intelligence Chief Sisira Mendis was instructed to pay Rs. 10 million in compensation to the victims.

The verdict followed hearings of 12 petitions brought by the Bar Association of Sri Lanka, victims’ families, Catholic clergy, and others before a seven-member bench led by Chief Justice Jayantha Jayasuriya.

SJB files intervention petition demanding dismissal of FR against Presidential Polls

July 15, Colombo (LNW): The Samagi Jana Balawegaya (SJB) has lodged an intervening petition urging the dismissal of Attorney-at-Law Aruna Laksiri’s petition challenging holding of the upcoming presidential election.

SJB MP Harshana Rajakaruna filed the intermediary petition in court today (15), coinciding with the scheduled hearing of Attorney-at-Law Aruna Laksiri’s Fundamental Rights (FR) petition seeking to halt the Presidential Election.

The FR petition is set for deliberation before a three-judge bench of the Supreme Court chaired by Chief Justice Jayantha Jayasuriya, alongside Justices Arjuna Obeysekera and Priyantha Fernando.

In his petition, Attorney-at-Law Aruna Laksiri argues for the suspension of the Presidential Election, citing the improper passage of the 19th Amendment to the Constitution in Parliament.

He advocates for a referendum to rectify this constitutional issue, asserting that holding the election under current circumstances violates Sri Lanka’s Constitution.

STF Commander suspects ‘highly trained’ shooters in Club Wasantha assassination

July 15, Colombo (LNW): Senior DIG Waruna Jayasundara has indicated that the individuals involved in the recent Club Wasantha murder are likely highly skilled, potentially with military or police backgrounds, judging by their proficiency with firearms.

In an interview with journalist Chamuditha Samarawikrama, DIG Jayasundara stressed the need for a comprehensive investigation to apprehend the shooters and uncover the masterminds behind the crime.

He underscored the importance of exploring all leads to determine the suspects’ backgrounds and affiliations.

Discussing recent successes, Jayasundara noted that the STF had recently captured two shooters linked to a murder in Kolonna, seizing firearms believed to be used in the crime.

Investigations revealed the involvement of “Rotumba Amila,” a member of an international drug syndicate, in orchestrating the murder plot, he added.

Responding to queries about weapons found at Club Wasantha’s residence in 2020, Jayasundara confirmed the STF’s discovery and subsequent handover of the weapons to local police for further inquiry.

Regarding their current status, he stated he lacked information as the STF’s role ends with arrests, leaving follow-up investigations and legal proceedings to the jurisdiction of local police and courts.

Govt allocates 116,000 scholarships under President’s Fund

July 15, Colombo (LNW): The government will award 116,000 scholarships in 2024 under President Ranil Wickremesinghe’s initiative to support the education of underprivileged children.

A total of Rs. 824 million has been allocated to provide Rs. 6000 per month for 24 months to 6000 G.C.E. (A/L) students.

Additionally, Rs. 3600 million will fund a programme granting Rs. 3000 per month for 12 months to 100,000 students from grades 1 to 11.

Rs. 288 million is designated for scholarships to student monks, Sheela Matha, and lay students in Piriven and Sheela Matha educational institutions.

Moreover, Rs. 720 million will support scholarships for students studying telecommunications for their G.C.E. (A/L) exams.

More than Rs. 5000 million will be allocated across various scholarship programmes, including:

Richard Pieris Group Chairman faces arrest over alleged sexual assault

July 15, Colombo (LNW): Sena Yaddehige, Chairman of Richard Pieris Group, is set to be arrested upon his return to Sri Lanka due to allegations of sexual assault involving a woman business analyst from the company.

The Kollupitiya Police secured a travel ban from the Fort Magistrate against Yaddehige following a complaint from a 39-year-old woman who claimed he assaulted her on May 7 at a high-end hotel in Kollupitiya.

The woman, who had been working remotely for the company, stated she was informed of Yaddehige’s return and requested to meet him, during which the alleged incident occurred.

Yaddehige reportedly left the country on the same day and has not returned since.

Kollupitiya Police have confirmed they are awaiting his arrival to enforce the travel ban and proceed with the arrest.
